Dear Attorneys,

My divorce is pending and my husband and I have been living separately for a few months now. I started pet-sitting to make some extra cash. I do no have a registered business. It’s mostly for friends and family, but I do get paid. My attorney asked me to fill out a financial affidavit, and I don’t know if I should include this income. How do I figure this out?

Dear Cathy,

It’s great that you found a way to make some extra money during your divorce! Since you are represented by an attorney, you should have an honest and open conversation with them about your “side hustle.” It’s certainly not uncommon for people to have multiple sources of income. However, it is imperative that your financial affidavit is as accurate and complete as possible. Remember that you are under penalty of perjury when you sign the financial affidavit (and have it notarized). So ultimately, yes, you will need to include it, but you may want to ask your attorney if there is a specific way in which they want you to do such.  This is especially true if the income is inconsistent.
