Dear Attorneys,

Stimulus checks are rolling out again, and it has me wondering – if I get a stimulus check, does it affect my child support? I really can’t afford to pay more than I already do.

Luckily, the answer to your question is that the stimulus check will NOT affect your child support payments. Depending on when you receive the check, what you do with it, and when you are running child support guidelines, you may or may not reflect it on your financial affidavit. Regardless, it will not go towards your child support calculations (unless you agree to such).

Now, if you are currently in the middle of a child support matter and/or modification, and your co-parent is framing your stimulus check as a substantial change in your financial status, you may want to consult with counsel.  Since its such a small amount, it would rarely qualify. However, if you have multiple children and one of you received all of the stimulus checks, you may want to address how, if at all, that would play into child support and/or what expenses it should be applied toward.
