taxes military pensions

Divorce may be one of the hardest things for anyone to go through. For most people, the emotional aspect of the process is daunting, but many find comfort in knowing that they can hire an attorney to handle the rest.

Often, when a military family is going through a divorce, there are even more complicated issues. If one parent has a deployment coming up, or is currently deployed, or if the parties have been married under ten (10) years, some things can become a little tricky. Additionally, if a party is receiving VA disability benefits, it is important to know what the benefits can, and cannot, be counted toward. It is imperative, whether the military service member is retired or currently enlisted, to have an attorney who is familiar with military divorce and division of military benefits. For example, military pensions are handled differently than civilian pensions, and housing stipends and/or other allotments need to be appropriately addressed.

It is extremely important for the lawyer handling the military divorce to understand jurisdiction over service members, and the unique rules which govern the division of military pensions, in order to ensure that everything is in compliance. For instance, not only will your attorney need to make sure your pension is valued correctly, and that the marital contribution is properly allocated, but they will also need to be sure to communicate with the Defense Finance and Accounting Service prior to the divorce to ensure that payments are set up for when you retire.
