Dear Attorneys,

I have a court date scheduled, but it is quite a ways away. I really need the court’s help now. Is there anything I can do to get that scheduled sooner? I have concerns about visiting with my kids, and I just can’t justify waiting 3 months to discuss those with a judge.

Dear Move,

That is a really good question, and we want you to know that you are not alone. Court dates are hard to come by in the era of COVID-19, and they are usually scheduled further out than you had expected.

There may be a way to move the court date up, so long as all parties and attorneys on the case give consent. There is a form available (CV116), known as a Caseflow Request, which you can use to attempt to move your court date up a bit. You will be given the option to describe why the court date should be heard sooner, and then also indicate that everyone on the case agrees.

Now, if everyone does NOT agree you are still able to file the request, but the chances of it being granted are much higher if all appearing parties are on board.
